1.2 We are not a party to any transaction between Users and do not guarantee the accuracy, safety, or legality of any listings or services on the Platform.

1.3 We may modify these Terms at any time. Your continued use of the Website after modifications constitutes your acceptance of the new Terms.

2. User Responsibilities & Assumption of Risk

2.1 Users must be at least 18 years old or have legal capacity to enter into contracts.

2.2 Users are solely responsible for verifying:

  • The authenticity of listings, sellers, and service providers.
  • The safety of transactions.
  • The legality of their activities on the Platform.

2.3 Monkeyset.com is NOT responsible for any fraud, misrepresentation, losses, or damages arising from user interactions.

2.4 Users assume all risks and must conduct their own due diligence before making payments or commitments.

2.5 Vendor Responsibility for Link Uploader Content

  • Vendors using the link uploader feature to import listings from external websites (e.g., Immobiliare.it, Idealista, Airbnb) acknowledge and agree that:
    • They have the legal right and authorization to upload and publish the content.
    • They take full responsibility for the accuracy, completeness, and legality of the uploaded content.
    • They confirm they are the lawful owner of the listing or have explicit authorization from the property owner.
    • Monkeyset.com does not verify, endorse, or assume any liability for the accuracy or authenticity of imported listings.

2.6 Vendors acknowledge that they are solely responsible for any claims, legal disputes, or damages resulting from incorrect, misleading, or unauthorized content uploaded to the platform.

3. No Liability for Transactions or Fraud

3.1 Monkeyset.com does not process payments and is not responsible for financial disputes between Users.

3.2 We are not liable for:

  • Scams, fraudulent listings, or misleading user information.
  • Failure of Users to fulfill contractual obligations.
  • Financial losses, chargebacks, or payment disputes.
  • Any direct, indirect, incidental, or consequential damages.

3.3 If a User is a victim of fraud, Monkeyset.com is NOT responsible, and the dispute must be resolved directly between the parties involved.

3.4 We do not provide refunds and do not intervene in payment-related issues. Users must contact their payment provider (PayPal, Stripe, bank, etc.) for chargebacks or claims.

3.5 Legal Claims from Third Parties

  • Vendors acknowledge that if a third party claims copyright infringement, false advertising, or any legal violation due to an uploaded listing (including via the link uploader), the Vendor is fully responsible for resolving the dispute.
  • Monkeyset.com is not liable for any legal claims, fines, penalties, or damages resulting from vendor-uploaded content.

4. Account Registration & Termination

4.1 Users must provide accurate and truthful information when creating an account.

4.2 We reserve the right to suspend, terminate, or ban accounts that:

  • Engage in fraudulent, illegal, or harmful activities.
  • Violate these Terms.
  • Attempt to damage the reputation or security of the Platform.

4.3 Account termination is at our sole discretion, and we are not obligated to provide prior notice or justification.

5. Prohibited Activities

Users must NOT:

  • Post fraudulent, illegal, or misleading listings.
  • Use the Platform for scams, money laundering, or fraud.
  • Harass, threaten, or exploit other Users.
  • Engage in hacking, data scraping, or automation bots.
  • Violate intellectual property rights or applicable laws.
  • Upload copyrighted or unauthorized content.
  • Import listings they do not own or have the legal right to publish.
  • Misrepresent property details, prices, or availability.

Violations may result in immediate account termination, legal action, and reporting to authorities.

6. Intellectual Property

6.1 All content, trademarks, and intellectual property on Monkeyset.com belong to us or licensed third parties.

6.2 Users may not copy, distribute, or use our content without permission.

7. Privacy & Data Protection (GDPR & International Laws)

7.1 Our Privacy Policy explains how we collect, store, and protect user data.

7.2 Users acknowledge that Monkeyset.com may share data with law enforcement if required by law.

  • Copyright infringement claims.
  • Unauthorized use of third-party data.
  • Any financial losses or disputes arising from their listings.

9. Governing Law & International Dispute Resolution

9.1 These Terms shall be governed by and construed under the laws of [Insert Country/State].

9.2 Any dispute shall be resolved exclusively by binding arbitration, waiving any right to a lawsuit or jury trial.
